Indefinite under refugee or humanitarian protection

You can apply to settle in the UK (known as ‘indefinite leave to remain’) if you have got a residence card as a refugee or as a person with humanitarian protection. Settling (known as ‘indefinite leave to remain’) means you can stay in the UK without any time restrictions.

What are the eligibility requirements for ILR under refugee or humanitarian protection:

The requirements to be met for indefinite leave to remain as a person granted refugee status or humanitarian protection are as follows:

  • You must have held a UK Resident Permit (UKRP) for a continuous period of 5 years
  • Your UKRP must not have been revoked or not renewed
  • You do not fall for refusal due to your character or associations
  • You do not represent a threat to national security

Family Reunion:

Your partner or child may be able to join or stay with you in the UK if:

  • You were part of a family before you were forced to leave your country
  • You have refugee status, 5 years’ humanitarian protection or settlement on protection grounds but do not yet have British citizenship

Your partner or child cannot join you if:

  • You have not received a decision on your asylum claim
  • You’re under 18

If their application is successful, your family members will be allowed to come to or stay in the UK with the same permission as you.

Eligibility and Documents Requirements for Partner:

  • The relationship between you and your partner must have existed before you left the country of your former habitual residence in order to seek asylum
  • You are able to provide proof of marriage or civil partnership or 2 years cohabitation
  • Proof of genuineness of relationship

Eligibility and Documents Requirements for Children:

  • Under the age of 18
  • Going to live with you and your partner
  • Not married or in a civil partnership

What if Indefinite under refugee or humanitarian protection is refused:

>Where the original grant of asylum or HP remains unchanged, but settlement is refused and limited leave is granted, there is no right of appeal. The decision to refuse settlement is not an appealable decision under the Nationality, Immigration and Asylum Act 2002.

If the application is unsuccessful because the Home Office has decided to take revocation action, the applicant has a right of appeal against the decision to revoke protection status under section 82(1)(c) of the Nationality Immigration and Asylum Act 2002 (as amended by section 15 of the Immigration Act 2014).

This right of appeal against the revocation of protection status exists even if another form of leave is granted.
