UK Fiancé Visa

The UK Fiance visa category is for engaged partners of British citizens or persons with indefinite leave to remain who wish to enter the UK and marry within 6 months of their arrival.  An application for a UK Fiance visa must be made from outside the UK.

UK Fiance visa application requirements:

To qualify for a UK Fiance visa, you must satisfy the following UK Visas and Immigration requirements:

  • Your partner is British or holds Indefinite Leave to Remain in the UK
  • You are both over the age of 18
  • You have met in person
  • You are both free to marry
  • Your relationship is genuine, and you intend to live together permanently in the UK
  • You intend to marry within six months of your arrival in the UK
  • Any previous relationships have broken down permanently
  • You will be adequately maintained in the UK without recourse to public funds
  • There is adequate accommodation for you and any dependents
  • You speak and understand English to the required level

How can you apply for a Fiance visa:

You can submit an application from outside the United Kingdom.

How can you meet the Fiance visa financial requirements:

 The minimum income of £18,600 before tax is required to meet the spouse visa financial requirement if there are no dependent children. If you have one dependent child, you will need an income of £22,400 before tax to meet the financial requirement. For any other children, the sponsor will need an extra £2,400 for each subsequent child.

You and your partner can use:

  • Salaried or non-salaried income from employment before tax
  • Income from self-employment or as a director of a limited company in the UK
  • Cash savings above £16,000
  • Money from a pension
  • Non-work income, for example from property rentals or dividends

Can you use income from benefits to meet Fiance visa financial requirement?

Where your partner is in receipt of any of the following benefits or allowances in the UK, you will be able to meet the financial requirement by providing evidence of “adequate maintenance” rather than meeting an income threshold:

  • Carer’s Allowance
  • Disability Living Allowance
  • Severe Disablement Allowance
  • Industrial Injuries Disablement Benefit
  • Attendance Allowance
  • Personal Independence Payment
  • Armed Forces Independence Payment or Guaranteed Income Payment
  • Constant Attendance Allowance, Mobility Supplement or War Disablement Pension
  • Police Injury Pension

Duration and conditions of fiancé visa:

If the you meet the requirements you will be granted fiance visa for a period not exceeding 6 months and subject to a condition of no recourse to public funds.

You will be expected to marry prior to the expiry of your visa.

You will not be permitted to undertake any employment or self-employment while you have visa as a fiancé(e). You will only be able to work in the UK once you have got married and your application for further leave to remain on that basis has been granted.

What if you do not get married within 6 months:

If the marriage does not take place within 6 months, then there is limited provision to apply to the Home Office to extend your stay as a fiancé. The application should be made prior to the expiry of your leave. You must show that there was a ‘good reason’ why the ceremony did not take place in that time and you must provide evidence that the ceremony will take place within the next six months.
